Software License Agreement

This Software License Agreement (the “License”) is between you and Eytan Shabtay, a sole proprietor operating as Ascended Digitals (“Ascended Digitals,” “we,” “us”) and covers the Puffly software: the web application, the app you can install from it on a phone or computer, the forms and booking pages you can put on your own website, and any updates (the “Software”). It is part of our Terms of Service, which control if the two ever conflict. By installing or using the Software, you agree to this License.
1. License
We grant you and your team members a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Software for your business’s internal purposes while you have an account in good standing. You may put the forms and booking pages we give you on websites you control, for your own business. The Software is licensed, not sold.
2. Restrictions
You may not, and may not let anyone else:
- copy, modify, or make derivative works of the Software, except for the embed code we provide;
- reverse engineer, decompile, or disassemble it, except where the law allows despite this limit;
- rent, lease, sell, sublicense, or offer it as a service to others, or use it to build a competing product;
- get around security, usage limits, or access controls, or access it through automated means we have not provided;
- remove or change any notices of ownership; or
- use it in violation of law or of the Terms of Service.
3. Updates
We update the Software from time to time, and updates may be installed automatically. Updates are covered by this License. We may add, change, or remove features, as the Terms of Service describe.
4. Your data
You own the data you put into the Software. How we collect, use, and protect it is explained in our Privacy Policy and Cookie Policy.
5. Third-party components and services
The Software includes open-source components, which are licensed under their own licenses, and it connects to third-party services you choose to use. Those services are governed by their own terms.
6. Ownership
We and our licensors own the Software, including all intellectual property in it and the Puffly and Puff names, logos, and characters. All rights not expressly granted are reserved.
7. Termination
This License ends automatically when your account ends or if you break it. When it ends, you must stop using the Software, remove any installed app, and take our forms and booking pages off your website.
8. Disclaimer and limitation of liability
The Software is provided “as is,” without warranties of any kind, to the fullest extent permitted by law. The disclaimers and limits of liability in the Terms of Service apply to the Software.
9. Export and legal use
You may not use or export the Software in violation of U.S. export laws or sanctions, or where its use is prohibited.
